Terms of Service

These Terms of Service ("Terms") govern your use of the Bad Habits mobile application (the "App") operated by JBA Web Agency SRL ("we", "us", or "our"). By downloading or using the App, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years of age to use the App. By using the App, you represent and warrant that you meet this requirement. The App is not directed to or intended for use by anyone under 18.

2. Account Registration

A valid email address is required to create an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. If you believe your account has been compromised, contact us immediately at alex@jbagency.ro.

3. Subscription and Billing

3.1 Free Trial

New users receive a 30-day free trial with full access to all App features. No payment information is required to start the trial.

3.2 Paid Subscription Plans

• Monthly: $2.99 per month
• Annual: $25.99 per year (approximately $2.17/month)

3.3 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your payment method will be charged at the start of each new billing period.

3.4 Cancellation

You can cancel your subscription at any time through your device's subscription settings (Google Play or App Store). Cancellation takes effect at the end of the current billing period — you retain access until that date.

3.5 Refunds

No refunds are provided for unused portions of a subscription period. Refund requests for exceptional circumstances may be considered on a case-by-case basis.

4. User Content

Your data — check-ins, vice selections, and circle activity — remains yours. We do not claim ownership of your content. When you are a member of an accountability circle, other circle members can see your spending totals by category only. Individual transaction details are never visible to other users.

5. Acceptable Use

You agree not to:

• Harass, threaten, or harm other users through circle interactions
• Provide false information or impersonate any person or entity
• Attempt to reverse engineer, decompile, or disassemble the App
• Circumvent, disable, or interfere with security or paywall features
• Use the App for any fraudulent or unlawful purpose
• Attempt to gain unauthorized access to any part of the App or its infrastructure

6. Intellectual Property

The App, including its design, features, code, branding, and content (excluding your user data), is owned by JBA Web Agency SRL and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written consent.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the maximum extent permitted by applicable law, our total liability to you for any claims arising out of or related to these Terms or your use of the App shall not exceed the total amount you paid to us in the 12 months preceding the claim.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, even if we have been advised of the possibility of such damages.

9. Indemnification

You agree to defend, indemnify, and hold harmless JBA Web Agency SRL and its officers, directors, and employees from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the App, your user content, or your violation of these Terms.

10. Termination

We may suspend or terminate your account if you violate these Terms, with or without prior notice. You can delete your account at any time from within the App (Profile > Settings > Delete Account). Termination does not entitle you to a refund for any remaining subscription period.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the date at the top of this page and, where appropriate, through in-app notifications. Your continued use of the App after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Romania. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of Romania.
